BOOM+ RUN 2026 TERMS AND CONDITIONS

By registering for and participating in this event (“Event”), the participant (“Participant”) agrees to the following Terms & Conditions set by The Boom Bevlab Sdn. Bhd (“Organizers”), including all affiliates, sponsors, partners, employees, contractors, and representatives.

1. ASSUMPTION OF RISK & WAIVER OF LIABILITY

1.1 The participant confirms that all personal details provided during registration, including age, are true, accurate, and complete.

1.2 The participant acknowledges that participation in the event involves inherent risks, including but not limited to accidents, personal injury, illness, permanent disability, or death, arising from physical exertion, equipment, crowd conditions, weather, and other participants.

1.3 The participant confirms that they are physically fit, in good health, and have no medical condition that would make participation unsafe, and voluntarily assumes all risks associated with participation.

1.4 To the fullest extent permitted by law, the participant waives, releases, and discharges the organizers, including their employees, agents, contractors, sponsors, and venue owners, from any and all claims, liabilities, damages, losses, or expenses arising out of or in connection with participation in the event, whether caused by negligence or otherwise, except in cases of gross negligence or wilful misconduct.

1.5 The participant consents to receive medical treatment deemed necessary during the event and agrees that any related costs shall be borne by the participant.

1.6 To the extent permitted by law, any liability of the organizers which cannot be excluded shall be limited to the total registration fee paid for the event.

2. INDEMNITY

2.1 The participant agrees to indemnify, defend, and hold harmless the organizers, including their employees, agents, contractors, sponsors, and venue owners, from and against any and all claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or in connection with the participant’s participation in the event, including any act, omission, or breach of these Terms & Conditions by the participant arising from:

A. The participant’s actions, negligence, or misconduct;
B. Breach of these Terms & Conditions;
C. Injury to other participants, spectators, or third parties caused by the participant.

2.2 The participant confirms that all personal details provided during registration, including age, are true, accurate, and complete.

2.7 To the extent permitted by law, any liability of the organizers which cannot be excluded shall be limited to the total registration fee paid for the event.

3. HEALTH, MEDICAL CONDITION & EMERGENCY CONSENT

3.1 The participant confirms that they are physically fit, in good health, and medically capable of participating in the event.

3.2 The participant is responsible for obtaining medical advice prior to participation where necessary.

3.3 The participant must disclose any known medical conditions, allergies, or injuries during registration.

3.4 The organizers reserve the right to deny participation or remove any participant deemed unfit or posing a safety risk, without refund.

3.5 The participant consents to receive first aid and/or emergency medical treatment deemed necessary during the event.

3.6 The participant agrees that any medical treatment, evacuation, or related services arranged by the organizers shall be at the participant’s own risk and cost.

3.7 The organizers shall not be liable for any injury, illness, or complications arising from any medical treatment or assistance provided.

4. EVENT RULES, CONDUCT & DISQUALIFICATION

4.1 The participant agrees to comply with all event rules, instructions, safety guidelines, and any directions issued by the organizers before or during the event. The organizers may take any action deemed necessary to ensure the safety, integrity, and orderly conduct of the event.

4.2 The organizers reserve the right to disqualify, remove, or refuse entry to any participant who:

● Violates event rules or instructions;
● Engages in dangerous, disruptive, abusive, or unsportsmanlike conduct;
● Fails to meet cut-off times, checkpoints, or course requirements;
● Provides false, incomplete, or misleading information; or
● Engages in any conduct, whether during or in connection with the event, that is intended to or reasonably likely to damage, defame, or bring the event, the organizers, sponsors, or brand name into disrepute or public ridicule.

4.3 Disqualified or non-finishing participants shall not be entitled to any refund, medal, race pack, certificate, or other event entitlements.

4.4 Any decision made by the organizers under this Clause shall be final and binding, and no appeal, dispute, or claim shall be entertained.

4.5 The organizers may involve or refer matters to relevant authorities, emergency services, or enforcement agencies where necessary.

5. RACE ENTRY, TRANSFER & IDENTIFICATION
Bib transfer clause:

5.1 All registrations are non-refundable.

5.2 Race entry transfers are permitted only through the organizers’ marketplace or designated platform (“Official Marketplace”), subject to applicable terms, deadlines, and administrative fees.

5.3 Any transfer, resale, or assignment of race entries outside the Official Marketplace is strictly prohibited and shall render the registration invalid without refund.

5.4 The organizers shall not be responsible for any disputes, losses, or issues arising from unauthorized transfers or third-party transactions conducted outside the Official Marketplace.

5.5 The organizers reserve the right to verify the identity of participants at any time, including but not limited to verification against registration records (e.g., NRIC, passport, or other identification).

5.6 Any mismatch, fraudulent registration, or unauthorized transfer may result in immediate disqualification without refund.

5.7 The organizers reserve the right to regulate or cap resale pricing on the Official Marketplace.

6. ROUTE, SAFETY & ENVIRONMENTAL CONDITIONS

6.1 The participant acknowledges that the event may take place on public or partially closed roads.

6.2 The participant must exercise caution at all times and be aware of vehicles, pedestrians, uneven surfaces, weather conditions, and other hazards.

6.3 The organizers shall not be responsible for risks arising from road conditions, weather, or external factors beyond their control.

6.4 Participants are required to familiarise themselves with the designated race route, course map, and related instructions prior to and during the event to avoid any confusion or misdirection.

6.5 Participants are solely responsible for following the correct route and course markings. Any deviation from the designated route shall be at the participant’s own risk, and the organizers shall not be held responsible for any loss of time, distance, disqualification, or related consequences.

7. TIMING, RESULTS & TECHNICAL LIMITATIONS

7.1 Official results are based on the event’s designated timing system and/or any manual verification process determined by the organizers.

7.2 The organizers shall not be liable for any discrepancies, omissions, delays, or technical errors arising from timing chips, tracking devices, systems, or equipment failures.

7.3 The organizers reserve the right to review, verify, and amend results where necessary, including in cases of suspected error, rule violation, or technical malfunction.

7.4 All timing and results decisions made by the organizers shall be final and binding.

8. PERSONAL PROPERTY & BAGGAGE

8.1 All personal belongings are brought to the event at the participant’s own risk.

8.2 The organizers shall not be liable for any loss, theft, or damage to personal property.

8.3 Baggage deposit or personal item storage services, if provided, may be operated by third-party service providers and are subject to their terms, conditions, and applicable charges. Any fees imposed by such third parties shall be borne by the participant and are non-refundable.

8.4 Participants use any baggage deposit or storage services at their own risk and acknowledge that the organizers are not responsible for the security or handling of stored items.

8.5 Participants are advised not to deposit valuables.

9. DATA PROTECTION & PRIVACY (PDPA COMPLIANCE)

9.1 The participant consents to the collection, use, and processing of personal data in accordance with the Personal Data Protection Act 2010 (Malaysia).

9.2 Personal data may include name, identification details, contact information, race results, and related data.

9.3 Such data may be shared with event partners, sponsors, service providers, and authorities strictly for event-related purposes.

9.4 The participant may opt out of non-essential marketing communications at any time.

10. MEDIA, IMAGE & PUBLICITY RIGHTS

10.1 The participant grants the organizers the irrevocable, worldwide right to use, reproduce, publish, and distribute photographs, videos, and recordings taken during the event for promotional, marketing, and commercial purposes, in any media format, without compensation.

10.2 The participant acknowledges that such materials may be used at the organizers’ sole discretion and agrees that they shall have no right to demand removal, deletion, or takedown of any such materials, provided such use complies with applicable laws.

11. FORCE MAJEURE & EVENT MODIFICATIONS

11.1 The organizers reserve the right to cancel, postpone, or modify the event due to circumstances beyond reasonable control, including but not limited to:

A. Adverse weather conditions
B. Natural disasters (e.g., haze, floods, lightning)
C. Pandemics or health emergencies
D. Government orders or permit issues
E. Safety or security threats
F. War

11.2 In such circumstances, registration fees are strictly non-refundable.

11.3 The organizers may, at their sole discretion, offer alternative arrangements (e.g., virtual event, rescheduling), without obligation.

12. EQUIPMENT & PERSONAL RESPONSIBILITY

12.1 The participant is responsible for ensuring appropriate attire, footwear, hydration, and equipment.

12.2 The organizers are not responsible for any injury or issue arising from inadequate preparation or equipment.

13. MINOR PARTICIPATION (IF APPLICABLE)

13.1 Participants under the age of 18 must obtain consent from a parent or legal guardian.

13.2 The parent/guardian agrees to these Terms & Conditions on behalf of the minor and accepts full responsibility.

14. AGE ELIGIBILITY, MINOR PARTICIPATION & EMERGENCY CONTACT REQUIREMENTS

14.1 Eligibility to participate in the event is subject to the following minimum age requirements:

A. 5KM Category: Open to all ages.
B. 10KM, 21KM & 30KM: Participants must be at least sixteen (16) years old based on the calendar year of the event (i.e., born in the year the participant turns sixteen or earlier).

14.2 Participants below eighteen (18) years old (“Minors”) must obtain prior consent from a parent or legal guardian before participation. The parent or legal guardian agrees to these Terms & Conditions on behalf of the Minor, confirms the Minor is fit to participate, and accepts full responsibility for the Minor’s participation.

14.3 All Minors must provide accurate and complete parent or legal guardian details during registration. All participants (including adults) must provide at least one (1) valid emergency contact, including name, relationship, and contact number. The organizers reserve the right to refuse participation if such information is incomplete, inaccurate, or unverifiable.

14.4 The participant (and where applicable, the parent or legal guardian) acknowledges that the emergency contact may be used in the event of an incident, and that the organizers shall not be liable for any failure to reach such contact due to incorrect or outdated information. The participant remains responsible for ensuring the emergency contact is reachable.

14.5 The organizers reserve the right to verify age and identity at any time and may require presentation of supporting documents (e.g. NRIC, passport, or birth certificate).

14.6 Any misrepresentation of age or falsification of guardian or emergency contact information may result in immediate disqualification without refund.

15. SHIRT SIZE EXCHANGE

15.1 Participants are required to select their preferred shirt size at the point of registration. All selected sizes are strictly final upon submission.

15.2 Requests for shirt size changes after registration will not be entertained. The organizers shall not be responsible for any incorrect size selection made by the participant.

15.3 Shirt sizes are subject to availability and are allocated on a first-come, first-served basis. The organizers do not guarantee the availability of all sizes.

15.4 No exchanges of shirt sizes will be allowed during race pack collection or on event day.

15.5 In the event that a selected size is unavailable due to unforeseen circumstances, the organizers reserve the right to substitute with an alternative size without prior notice, and such substitution shall not entitle the participant to any claim or compensation.

16. NO CHANGE OF NAME

16.1 All registrations are strictly non-transferable and cannot be amended to another individual’s name once confirmed.

16.2 Requests for name changes after registration will not be entertained under any circumstances.

16.3 Any participant found running under another person’s name or allowing another individual to use their registration shall be subject to immediate disqualification without refund.

16.4 The organizers reserve the right to verify participant identity at any time, and failure to provide valid identification upon request may result in disqualification

17. NO CHANGE OF GENDER & CATEGORY

17.1 Participants are required to select their gender and race category accurately at the point of registration. All selections are strictly final upon submission.

17.2 Requests to change gender or race category after registration will not be entertained under any circumstances.

17.3 The organizers reserve the right to verify participant details, including gender and category eligibility, at any time. Failure to provide valid supporting identification may result in disqualification.

17.4 Any participant found competing under an incorrect gender or category, whether intentionally or otherwise, may be disqualified at the sole discretion of the organizers.

17.5 In the event that a participant wins or is entitled to any prize under an incorrect gender or category classification, such results, prizes, and entitlements shall be automatically forfeited, and the organizers reserve the right to reassign rankings and prizes accordingly.

18. DELIVERY OF RACE ITEMS

18.1 Participants may choose to receive their shirt and bib number either via self-pickup at the designated collection point or through delivery as arranged by the organizers.

18.2 Delivery applies strictly to jerseys and bib numbers only. If participants choose the delivery option, goodies or any additional race pack items are not included and are not allowed to be collected during race pack collection (REPC).

18.3 The organizers will not entertain any requests to change the delivery address or to amend the selected option between self-pickup and delivery. Participants are responsible for selecting the correct option at registration.

19. EVENT CHANGES & FLEXIBILITY

19.1 The organizers reserve the right to amend, modify, or adjust any aspect of the event at any time for safety, operational, or regulatory reasons.

19.2 This includes, but is not limited to:

● Changes to the race route or course layout
● Adjustments to the event date or start time
● Modifications due to weather conditions or unforeseen circumstances

19.3 Participants acknowledge and agree that such changes may be made without prior notice and shall not entitle the participant to any refund, compensation, or claim.

20. INSURANCE COVERAGE

20.1 Participants are covered under the event’s insurance policy strictly based on their registered name and assigned race bib number.

20.2 Any participant running under a different name or using another individual’s bib will not be covered under the event insurance.

20.3 The organizers shall not be liable for any injury, loss, or damage sustained by participants who are not properly registered or verified under the official event records.

21. COMMERCIAL & SPONSOR PROTECTION

21.1 All race entries are strictly for personal participation only and shall not be resold, transferred for commercial gain, or used for promotional purposes without prior written consent from the organizers.

21.2 Unauthorized vendors, hawkers, or commercial activities are strictly prohibited within the event venue and surrounding areas without official approval from the organizers.

21.3 The organizers reserve the exclusive right to manage and protect all event sponsorships, branding, and commercial rights.

21.4 Participants, partners, or third parties shall not engage in any activity that conflicts with or undermines the interests of the event’s official sponsors.

21.5 The organizers reserve the right to take necessary action, including removal, disqualification, or legal action, against any party found violating this clause.

22. GENERAL

22.1 The organizers reserve the right to amend these Terms & Conditions at any time without prior notice.

22.2 If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force.

22.3 These Terms & Conditions shall be governed by and construed in accordance with the laws of Malaysia.
